These Terms of Use (“Terms”) govern your access to and use of the Certified Pet Parent mobile application and related website materials operated by MDK Ventures LLC (“we,” “us,” or “our”). By using Certified Pet Parent, you agree to these Terms.
1. Entertainment product
Certified Pet Parent is an entertainment product. Results, scores, classifications, commendations, citations, and comments are humorous and provided for entertainment purposes only.
2. Nature of certificates
Certificates offered through Certified Pet Parent are novelty/personalized entertainment products. They are not governmental, professional, educational, veterinary, medical, or legal certifications, licenses, or credentials of any kind.
3. Free result and optional purchase
The personalized review result is free. You may optionally purchase a Reviewed & Sealed personalized certificate. Under the current product offering, that optional certificate purchase is $3.99 through Apple’s in-app purchase system.
The certificate purchase is a consumable one-time purchase for the particular certificate transaction. There is no subscription under the current offering.
4. Payments, Apple, and refunds
Payment processing for App Store purchases is handled by Apple. We do not receive your credit-card or banking information.
Refund requests for App Store purchases are subject to Apple’s policies and processes. Please use Apple’s standard refund request process for App Store transactions.
5. Your content and responsibilities
You are responsible for the information and photos you choose to provide. If you choose an image for a certificate, you represent that you have the right to use that image and that your use does not infringe the rights of others.
Under the current implementation, pet photos selected for certificates are processed locally on your device and are not uploaded to our servers.
6. Intellectual property
Certified Pet Parent names, logos, seals, certificate designs, copy, and other branding and content are owned by MDK Ventures LLC or its licensors and are protected by applicable intellectual-property laws. You may not copy, modify, distribute, sell, or create derivative works from our branding or content except as expressly permitted by us or by law.
7. Acceptable use
You agree not to misuse the app or website, attempt unauthorized access, interfere with service operation, or use Certified Pet Parent for unlawful purposes.
8. Disclaimer of warranties
Certified Pet Parent is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant uninterrupted or error-free operation.
9. Limitation of liability
To the fullest extent permitted by law, MDK Ventures LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of Certified Pet Parent. Our total liability for any claim arising out of these Terms or the service will not exceed the greater of (a) the amount you paid us for the specific certificate purchase giving rise to the claim, or (b) USD $3.99.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Changes to these Terms
We may update these Terms from time to time. The effective date above will be revised when changes are posted. Continued use after changes become effective constitutes acceptance of the updated Terms.
